If this Application is submitted and approved by Eckerd Connects it shall become a contract and shall be subject to the following terms:
- Contributions to Eckerd Youth Alternatives, Inc. (DBA Eckerd Connects) which are received by the Applicant (“Individual Contributions”) and made by the Applicant will be sent to Eckerd Connects no later than thirty (30) days after the Fundraiser/Event. The Individual Contribution and the Applicant’s Contribution will be paid in United States dollars and sent via check to Eckerd Connects, 100 Startcrest Drive Clearwater, FL 33765, Attn: Fund Development.
- In performing its obligations under this Application, the Applicant will comply with all applicable federal, state, and local laws and regulations including, but not limited to, all laws and regulations that regulate statements to the public concerning the amount of the Contribution. Each reference to the Applicant’s Contribution will specifically and accurately describe the Applicant’s Contribution (e.g., Income less expenses should not exceed 25% of revenue and should be submitted within 30 days of the event).
- Applicant will state that no portion of the purchase price of any goods/services sold at the Fundraiser/Event is tax deductible unless donation is made directly to Eckerd Connects using Q-giv website platform or by check made to Eckerd Connects. If such is the case, the Individual donor will receive an acknowledgement letter from Eckerd Connects for use as a tax-deductible receipt.
- The Applicant will not represent that Eckerd Connects is a producer, co producer, sponsor, or presenter of the Fundraiser/Event.
- This Application does not create any partnership, agency, or joint venture relationship between the Applicant and Eckerd Connects, and neither Eckerd Connects nor the Applicant will make any representations to the contrary.
- Upon approval of the Fundraiser/Event, Applicant may state in promotional materials that proceeds from the Fundraiser/Event will be donated to Eckerd Connects. In connection with such statements, and for no other purpose, Eckerd Connects grants to the Applicant a non-exclusive license to use the Eckerd Connects name and logo upon and in connection with the Fundraiser/Event. The Applicant shall have no right to grant any sublicenses under this Agreement. The Applicant will provide Eckerd Connects with sample copies for approval of all publicity or promotional materials that include Eckerd Connects name or logo prior to publication or distribution.
- If Eckerd Connects determines, in its sole discretion, that the Fundraiser/Event or related activities could injure the goodwill or reputation of Eckerd Connects, Eckerd Connects may terminate this Agreement immediately. Upon the expiration or sooner termination of Fundraiser/Event, the Applicant shall discontinue using the Eckerd Connects name and logo and all materials that reference the Fundraiser/Event.
- Applicant is not permitted to dispense or serve alcoholic beverages at approved Fundraiser/Events where individuals under the legal drinking age are to be in attendance.
- This Application requires that the Applicant carry liability insurance for the Fundraiser/Event. The Applicant can obtain insurance coverage from a company of their choosing. Eckerd Connects will also allow the applicant to waive the liability insurance requirement and still be permitted to host the Fundraiser/Event. The Applicant understands by waiving the obtaining of insurance means that the applicant will bear the costs of their own losses such as via fire, theft, injury, and so forth. Eckerd Connects strongly recommends and prefers that the Applicant obtain insurance coverage.
- Applicant shall release, defend, indemnify, and hold Eckerd Connects, its directors, officers, employees, agents, attorneys, representatives, volunteers, successors and assigns, harmless from all claims, liabilities, judgments, penalties, losses, costs, damages and expenses (including reasonable attorneys’ fees, whether or not litigation is instituted) paid or incurred by Eckerd Connects by reason of any activities relating to this Fundraiser/Event.
